1. Acceptance of Terms

By accessing or using any NIAMÈS service, submitting a booking request, engaging with our concierge team or using our website, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you ("Client") and NIAMÈS.

If you do not agree to these terms, please do not use our services. NIAMÈS reserves the right to modify these terms at any time. Continued use of our services after notification of changes constitutes acceptance of the revised terms.

2. Services

NIAMÈS provides a luxury concierge platform connecting clients with verified independent beauty, grooming and wellness professionals. Our services include, but are not limited to:

• Hair styling, treatment and extension services
• Barbering and executive grooming
• Professional makeup artistry
• Massage and wellness treatments
• Nail care services
• Personal styling and image consulting
• Bridal beauty coordination
• Event grooming and preparation

NIAMÈS acts as a concierge intermediary. The actual services are delivered by independent professionals in our network. NIAMÈS takes full responsibility for professional vetting and the quality standards of the experience we coordinate.

3. Bookings and Scheduling

All bookings are subject to availability. A booking is confirmed only upon written confirmation from the NIAMÈS concierge team via email or WhatsApp.

• Booking requests should be submitted at least 24 hours in advance for standard clients
• Members may access same-day booking based on their tier
• All bookings include a service location, agreed time and assigned professional
• Changes to confirmed bookings must be requested at least 8 hours in advance
• NIAMÈS reserves the right to substitute a professional in exceptional circumstances, with advance notice

4. Payments

Service fees are communicated at the time of booking confirmation. Accepted payment methods include mobile money, bank transfer, card payment and member account billing.

• Full payment or a deposit may be required to confirm a booking
• Membership fees are billed according to your agreed membership terms
• Boutique purchases are payable at checkout
• All prices are inclusive of applicable taxes unless stated otherwise
• NIAMÈS reserves the right to adjust pricing with reasonable notice to members

5. Cancellation and Rescheduling

We understand that schedules change. Our cancellation policy is as follows:

• More than 24 hours' notice: Full refund or credit, no charge
• 12–24 hours' notice: 50% cancellation fee applies
• Less than 12 hours' notice: Full service fee applies
• No-show (professional arrives, client unavailable): Full service fee plus a travel surcharge

Rescheduling with more than 12 hours' notice is available at no charge. Members may benefit from more flexible cancellation terms based on their tier.

NIAMÈS reserves the right to cancel an appointment due to professional illness or other extraordinary circumstances. In such cases, we will notify you immediately and arrange a replacement or full refund.

6. Professional Standards and Client Responsibilities

To ensure an excellent experience for both clients and professionals, clients agree to:

• Provide a safe and suitable environment for the professional to deliver the service
• Treat NIAMÈS professionals with respect and courtesy at all times
• Be available at the confirmed time and location
• Provide accurate information about service requirements, allergies and sensitivities
• Not request services outside the agreed scope without prior arrangement
• Not solicit NIAMÈS professionals for private bookings outside the NIAMÈS platform

NIAMÈS reserves the right to suspend or terminate client access for any conduct that is disrespectful, unsafe or in breach of these terms.

7. Intellectual Property

All content on the NIAMÈS website and marketing materials — including text, images, logos, brand elements and design — is owned by or licensed to NIAMÈS and protected by applicable intellectual property laws.

You may not reproduce, distribute, modify or create derivative works from any NIAMÈS content without our express written permission. The NIAMÈS name, logo and "Luxury. Privacy. Precision." tagline are proprietary marks of NIAMÈS.

8. Limitation of Liability

NIAMÈS takes every reasonable precaution to ensure the quality and safety of services delivered through our platform. However:

• NIAMÈS is not liable for any allergic reactions arising from services where the client has not disclosed relevant sensitivities
• Our liability for any claim arising from a service is limited to the value of that service
• NIAMÈS is not responsible for any indirect, consequential or special damages
• Any claims must be raised within 7 days of the service date

Nothing in these terms excludes liability for personal injury caused by negligence, fraud or any matter where liability cannot be excluded by law.

9. Privacy

Your privacy is fundamental to the NIAMÈS model. The collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you agree to our Privacy Policy.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Kenya. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Kenya.

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
